Terms & Conditions

      Plain language summary: Use our apps fairly, don't do anything illegal, and respect our work. We build with care and ask that you engage with our products in the spirit they were made.
    

1. Acceptance of Terms

By downloading, installing, or using any application or game published by fcount labs ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our products.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes on devices you own or control, subject to these Terms and the applicable platform (Apple App Store / Google Play) terms of service.

3. Prohibited Uses

You agree not to:

Reverse-engineer, decompile, or disassemble any part of our apps
Modify, adapt, or create derivative works from our apps
Use our apps for any unlawful purpose or in violation of any regulations
Attempt to extract source code, assets, or proprietary data from our apps
Exploit bugs or vulnerabilities for unfair advantage in games
Resell, sublicense, or commercially exploit our apps without written permission

4. Intellectual Property

All content, design, graphics, code, sound, and other materials within our apps are the intellectual property of fcount labs or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you ownership of any of our intellectual property.

5. In-App Purchases

Some apps may offer optional in-app purchases. All purchases are final and governed by the applicable platform's refund policies (Apple App Store or Google Play). We do not process payments directly and do not store your payment information.

6. Privacy

What each app collects — for most of them, nothing that leaves your device — is described in our Privacy Policy, which is incorporated into these Terms by reference. We collect only what an app needs to run, and we never sell it.

7. Player Names and Content You Submit

In apps where other people can see what you do — Quiz Showdown's leaderboards, duels and player-written questions — you agree to:

Choose a player name that is not offensive, hateful, sexual, or pretending to be someone else, including fcount labs or its staff
Submit only questions you have the right to share, and that are accurate to the best of your knowledge
Play fairly: no bots or automated play, and no exploiting bugs to climb a leaderboard

When you submit a question, you give fcount labs a free, worldwide, non-exclusive licence to edit it and use it in our apps. Every submitted question is reviewed before anyone else sees it, and we may decline, edit or remove any question, rename any player name that breaks these rules, and remove scores gained unfairly. Some opponents and board entries in Quiz Showdown are computer-played; they are part of the game and not other people.

8. Disclaimers

Our apps are provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that our apps will be error-free, uninterrupted, or free of viruses or other harmful components. Use is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, fcount labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of our apps, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims under these Terms shall not exceed the amount you paid for the app giving rise to the claim in the twelve months prior to the event (or $10 USD if no purchase was made).

10. Modifications to Apps and Terms

We reserve the right to modify, update, or discontinue any app at any time without prior notice. We may also update these Terms at any time. Continued use after any change constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which fcount labs is registered, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
